Terms of service

§ 1 Scope

These Terms of Service apply to all orders placed through the PawPorter online store between HP Ecommerce, owner Henry Plück, Thürpfad 3, 65199 Wiesbaden, Germany ("we", "us") and our customers. A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession.

§ 2 Conclusion of contract

The presentation of products in our store does not constitute a legally binding offer, but an invitation to place an order. You can add products to your cart and enter your details during checkout. Before submitting your order, you can review and correct all information. By clicking the order button, you submit a binding offer. We confirm receipt of your order by email. The contract is concluded with our order confirmation or shipping confirmation, at the latest upon delivery of the goods. When paying via PayPal, credit card, Apple Pay, Google Pay or Klarna, the contract is concluded upon completion of the payment process.

§ 3 Contract language and storage of contract text

The contract language is English. We store the contract text and send you the order details and these Terms by email. These Terms are available on this page at any time.

§ 4 Prices and shipping costs

All prices are final prices. In accordance with § 19 of the German VAT Act (UStG), no VAT is charged or shown (small business regulation). Any shipping costs are displayed during checkout. Orders of €50 or more ship free of charge. For deliveries outside the EU, including the USA, customs duties, import taxes and fees may apply; these are borne by the customer unless stated otherwise at checkout.

§ 5 Payment

Available payment methods are shown during checkout (e.g. credit card, PayPal, Apple Pay, Google Pay, Klarna). The terms of the respective payment provider also apply.

§ 6 Delivery

We ship worldwide. Unless otherwise stated on the product page, delivery takes 10–12 business days after conclusion of the contract (for prepayment, after receipt of payment). Details can be found in our Shipping Policy.

§ 7 Retention of title

The goods remain our property until paid in full.

§ 8 Right of withdrawal

Consumers have a right of withdrawal. Details can be found in our Refund Policy.

§ 9 Warranty

Statutory warranty rights apply. Please report obvious transport damage to the carrier where possible and notify us; this does not affect your statutory rights.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. In cases of slightly negligent breach of essential contractual obligations, our liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

§ 11 Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence. Should any provision be invalid, the validity of the remaining provisions shall not be affected.
